Jackson Bay Charters Limited – Terms & Conditions
Effective Date: 1st May 2025
By booking a trip with Jackson Bay Charters Limited ("JBC Ltd"), you confirm that you have read, understood, and agreed to the following terms and conditions. These apply to all fishing, diving, sightseeing tours, and charter services provided by us.
1. Definitions
Booking: A confirmed reservation, validated by JBC Ltd, including vessel name and pricing, whether in electronic or physical form.
Client: The individual or entity requesting services from JBC Ltd.
Contract: These terms, along with any quote, invoice, or supplemental documents.
Cookies: Small data files used on our website to enhance user experience.
Equipment: Any item provided by JBC Ltd for hire or use.
Incidental Items: Materials or media produced or provided by JBC Ltd.
JBC Ltd: Jackson Bay Charters Limited, including successors and assigns.
Maritime Law: Governing laws and regulations applicable to nautical activity.
Mayday: A recognized international distress signal.
Price: The agreed fee for services rendered.
Services: All offerings provided by JBC Ltd as requested by the Client.
Vessel: Any watercraft supplied by JBC Ltd for service or recreation.
2. Acceptance of Terms
By making a booking or using our services, you accept these terms.
In case of conflicting documents, these terms take precedence.
Medical conditions or disabilities must be disclosed at booking.
JBC Ltd must respond to Mayday signals if nearby and conditions are safe.
Trips may be rescheduled or cancelled due to safety or minimum number requirements.
Website pricing is subject to change and only confirmed upon deposit and receipt of confirmation email.
Clients must notify JBC Ltd of changes to personal details.
Electronic signatures are valid and binding.
Group composition (e.g., age, gender) may affect pricing.
Children under 16 must be accompanied unless prior approval is given.
No smoking or illegal substances allowed aboard. Intoxicated persons may be refused boarding.
3. Bookings & Payment
A 25% deposit is required to confirm all bookings.
Full payment is due 7 days prior to departure unless otherwise arranged.
Group bookings must designate one primary contact responsible for all communication and payment.
All pricing includes GST.
4. Cancellations & Refunds
Customer Cancellations:
- More than 14 days before departure: Full deposit refund.
- 7–14 days before departure: 50% of deposit refunded.
- Less than 7 days: Deposit is non-refundable.
- No-shows receive no refund.
Operator Cancellations:
- JBC Ltd may cancel trips due to weather, mechanical issues, or unforeseen circumstances.
- You may choose to reschedule or receive a full refund.
- We are not responsible for accommodation or travel costs due to cancellations.
5. Weather & Safety
All trips are subject to weather and sea conditions. The skipper’s decision is final.
Passengers must follow all crew instructions.
If a trip is shortened due to conditions, partial credit or a refund may be offered at our discretion.
6. Passenger Requirements
All clients must be in suitable physical condition for their chosen activity.
Divers must present certification and pass a safety check.
Entry may be denied without a refund if alcohol or drugs impair safety.
7. Equipment & Liability
Fishing equipment, safety gear, and lifejackets are supplied unless stated otherwise.
Divers must bring their own certified and functional equipment.
JBC Ltd is not liable for lost or damaged personal belongings.
All participation is at your own risk unless injury is due to proven negligence.
8. Catch & Legal Limits
All catches must comply with New Zealand fishing regulations.
Craypots are part of the experience, but crayfish are not guaranteed.
The skipper determines if the catch is safe and legal to retain.
JBC Ltd supports sustainable fishing practices.
9. Alcohol & Smoking
Alcohol is allowed in moderation on private charters only.
The skipper may prohibit alcohol if necessary for safety.
Trips may be cancelled without a refund for intoxicated passengers.
Smoking is strictly prohibited on all vessels.
10. Minimum Numbers & Mixed Charters
Some trips require minimum bookings (e.g., 4 guests for tours, 2 for diving).
If minimums aren’t met, we’ll offer a reschedule or a full refund.
11. Media & Photography
Photos and videos may be taken during your trip for promotional purposes.
Please notify us before departure if you do not wish to appear in any media.
12. Limitation of Liability
JBC Ltd and its staff are not responsible for:
- Personal injury, property damage, or loss unless caused by proven negligence.
- Costs or losses from delays, schedule changes, or cancellations.
13. Health & COVID-19 Compliance
We comply with all New Zealand government health and safety regulations.
If unwell, contact us early to discuss rescheduling options.
14. Provision of Services
Services begin once you board the vessel.
Missed departures may be rescheduled for a fee.
We are not liable for delays or service disruptions beyond our control.
15. Equipment Hire
All hired equipment remains the property of JBC Ltd.
Clients are responsible for proper care.
Lost or damaged items must be replaced at the client's cost.
16. Privacy Policy
We handle personal data per the NZ Privacy Act 2020 and GDPR.
You may request access to or correction of your data.
Our website discloses the use of cookies and tracking tools.
Personal information may be used for credit checks or marketing with consent.
Privacy concerns may be raised directly with JBC Ltd or the NZ Privacy Commissioner.
